Donald Trump petitioned the U.S. Supreme Court to intervene in his dispute with E. Jean Carroll, citing risks to presidential liability. His filing argues the Supreme Court should recognize presidential immunity for statements he says were official acts under Trump v. United States. The petition challenges a Second Circuit ruling and asserts substitution under the Westfall Act should have applied. Trump’s lawyers contend the denials from the White House were made while addressing reporters about fitness for office and should not expose a president to personal damages. They ask the Court to resolve what they call novel constitutional questions as interest accrues and to prevent a precedent they describe as hazardous for future administrations.
